The agreement between you and Aartan Group Pty Ltd governing your use of TrailScope.

These Terms form a binding agreement between you (or the brokerage you represent) and Aartan Group Pty Ltd. By creating a TrailScope workspace or accepting an invitation to one, you agree to be bound by them.
TrailScope is provided to licensed Australian mortgage brokers and authorised credit representatives operating under the National Consumer Credit Protection Act 2009 (Cth). You confirm you are authorised to upload the portfolio data you provide.
TrailScope is currently provided free of charge. There are no paid plans, no trial period and no payment details are collected. If we introduce paid plans in future, we will notify account admins by email in advance and existing workspaces will not be charged without opting in. You can export your data or delete your account at any time from Settings.
You retain all ownership of the portfolio data you upload. We hold a limited licence to process it for the purpose of delivering the service to you. You can export your data at any time from Reports, and request a full export by emailing support@trailscope.com.au.
AI Insights is bring-your-own-key. Prompts go to the provider you configure (Anthropic, OpenAI or Google) under your own account and are governed by that provider’s terms — including whatever they say about training. We do not operate a shared AI key, and if you have not added one, no prompts leave the platform.
We target 99.9% monthly availability of the authenticated workspace. The service is provided as-is without express warranty beyond what is non-excludable under Australian Consumer Law.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability under a non-excludable consumer guarantee can be limited, it is limited (at our option) to re-supplying the service or paying the cost of having it re-supplied.
Subject to the paragraph above, and to the maximum extent permitted by law, our total aggregate liability for all claims arising out of or in connection with these Terms or the service is capped at the greater of (a) the fees you paid us in the 12 months preceding the claim, or (b) AUD $100. Because TrailScope is currently provided free of charge, the AUD $100 floor is what applies. We are not liable for indirect or consequential loss, lost commission, lost profits, or loss of business opportunity.
You can delete your workspace at any time from Settings. We may suspend accounts that breach the acceptable-use clause.
These Terms are governed by the laws of New South Wales, Australia. Disputes are subject to the exclusive jurisdiction of the courts of that state.
